Pelago Travel Ltd Terms and Conditions

We refers to Pelago Travel Ltd, a company registered in England with company number 10069848. Registered office: Diamond Court, Water Street, Bakewell, Derbyshire DE45 1EW.

When we refer to our Tours this means any holiday, or component such as accommodation, transport, activity or function, organised or advertised by us. When we refer to You this means the lead person who has completed the booking form and includes all the people on whose behalf you have booked. When we use the term Supplier this means the company or person providing services, or any part of, within the overall tour package.

1. Your holiday contract

Please read these conditions carefully because your booking and payment for a Pelago tour constitutes acceptance of them. A contract will take effect between you and us when we have received a booking form and correct deposit, and we have sent you an email of our acceptance of your booking. At this point we will send you our full Terms & Conditions. No other travel documents will be issued until at least 8 weeks before the tour departure date.

2. Lead name

The lead name on any booking with us accepts the full responsibility of collecting the full balance payable for the booking and indemnifies Pelago against any loss from any individual failing to pay within your party. The lead name is also responsible for ensuring that all members of that party are aware they are bound by our terms and conditions. The lead name is also responsible for the completion of the online guest list on behalf of all persons on the booking. It is understood that those booking via email or telephone agree to, and accept our terms and conditions.

3. Tour eligibility

Our tours are primarily developed for adults, so you and your travelling companions are sure to share interests and foster a congenial atmosphere of fun and learning. However, Great British Explorer Tours may be suitable for some older children.  You need to be in good health, free of infectious or contagious illness, and have a level of fitness which would not spoil other participants’ enjoyment of the holiday – see Detailed Tour Itineraries to help you decide the tour’s appropriateness for you.  Coaches, some hotels that we may use and some historic buildings we may visit are not always easy to use or access if you have certain disabilities. Should any member of your party suffer from any disability or medical condition which may affect their or other people’s holidays you must provide full written details at the time you book the holiday, including any specific requirements that person has. Additionally, at the time you book the holiday you must provide written confirmation that you will provide all assistance the disabled person requires. However, given the nature of our tours, Pelago Travel reserves the right to accept or reject any person as a tour participant. If during the tour it transpires you are not able to cope adequately, or are ill, you may be asked to opt out of certain visits, or be asked to leave the tour altogether. This would be at your own expense.

4. Insurance

Pelago tours do not include the cost of travel insurance. It is a condition of booking that you have adequate holiday insurance. Cover for medical treatment, repatriation, loss of property and cancellation charges must be included. If you are making your own flight/travel arrangements, please ensure you have insurance in place that protects you in the unlikely event of Pelago Travel cancelling the tour.

5. Passports and visas

Your passport needs to be valid for six months beyond the date of the tour. You should ascertain whether visas are required, and obtain them if they are. Your consular office or travel agent will be able to help with this.

6. Paying for your holiday

When you book your holiday you must pay a deposit payment, we cannot confirm your booking until we have received your correct deposit. Payments are split into the following phases: an initial 10% (of total cost) non-refundable deposit is payable at the time of booking, per person.

The final balance is to be paid no less than 56 days before the date upon which your Pelago tour is due to start.

For bookings made after the balance due date, the full amount is due at the time of booking.

You can make payments at any time between paying the deposit and the balance due date.

If you do not make your balance payments by the due date given we reserve the right to cancel your holiday arrangements and retain the deposit paid to cover costs incurred.

Deposits are used by us to enter into the contractual arrangements on your behalf and are non refundable.   Please ensure that you have adequate travel insurance to cover possible loss of your deposit.

Payments can be made with a valid Credit Card or Debit Card, online bank transfers or cheque(s) – contact us for payee details.

Any payment by cheque must be cleared funds before it can be considered as received. If a promised cheque is not received or does not clear upon presentation, we hold the right to cancel the reservation and may incur an administration charge.

If you have a voucher from Pelago Travel Ltd only one can be used per booking.

7. Cancellation by us

We might decide to cancel a tour if at any time up to 57 days before departure there were insufficient bookings for it to be viable. We would refund everything you had paid to us. We may also cancel a tour if hostilities, civil unrest, natural disaster or other circumstances amounting to force majeure affect the region to which the tour was due to go.

If we cancel the whole of the tour we will do our best to rearrange the tour on a mutually convenient date, or provide a refund to you of the cost to us of the tour if within 56 days of departure date. Save as above we shall be under no further liability to you for cancellation of the tour or any part of it.

8. Cancellation by you

You may cancel your booking up to 57 days before the tour is due to start and you will only forfeit the deposit. If you cancel 56 days or less from the start of the Pelago tour you will forfeit 100% of the tour cost.

If you cancel your booking in a double or twin room but are travelling with a companion who chooses to continue to participate on the tour, the companion will be liable to pay the stipulated single supplement.

We take as the day of cancellation that on which we receive written (includes email) confirmation of cancellation.

9. Failure to provide a tour

If, due to reasons beyond our control, a tour is unable to take place due to (but without limitation) closure of premises, the ceases of trading, a change in supplier management, weather restrictions, we will provide you and your group with an alternative tour and if this does not prove possible, a refund to you of the cost to us of the tour.

10. Financial protection

We provide full financial protection for our package holidays. We do not provide flights as part of our package. We are members of Protected Trust Services. Any monies paid in advance of your holiday are held in a secure trust account, which is fully compliant with UK 1992 Package Travel Regulations.   This means that you will be fully refunded for any monies you have paid to us in the unlikely event of our insolvency. Many of the services which make up our tours are provided by independent suppliers, often in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier’s liability to you, usually in accordance with applicable international conventions.

11. Meals

Breakfast is included with accommodation bookings. Restaurant meals may require a pre-order to be completed by the lead name of the group. This should be completed and returned to us. If a pre-order has not been completed, we accept no liability for meals not provided or delays in providing the meals for you. If you arrive late then we accept no liability. We will endeavour to meet any specialist dietary requests for any member of your party, but cannot guarantee these requests. We accept no liability if our suppliers are unable to meet these requests in advance, or once at the venue.

12. Alterations and surcharges applied by us

If due to circumstances beyond our control it becomes necessary to substitute an alternative supplier, or make any other alterations to the tour (including accommodation) we will inform you of the changes as soon as possible. It is possible that changes beyond our control may result in pricing changes. You may be required to pay any additional cost due to such changes. If the changes are, in the view of Pelago Travel, so substantial as to materially alter the tour and you are unwilling to accept them then you may cancel the tour and we will give a refund of the cost of the tour to you. Surcharges may be applicable where part of a tour requires a minimum number of participants to proceed, and the group does not meet this minimum number. This could lead to the cancellation of the tour of which we are not held responsible and alternatives may be offered of an equal or greater value. If this value is greater, then we may need to ask you to pay us the difference in price.

13. Alterations made by you

We will try to accommodate any reasonable changes you wish to make to your booking. Alterations and amendment requests should be made with us and not end suppliers and should be made in writing (email is acceptable) to us by the lead name. These changes shall not be deemed accepted until we have confirmed by email to you. Amendments after the final payment date may incur our administration charge of £50.00 per person.   Where you are prevented from proceeding with your booking you may transfer your booking to another person who satisfies the eligibility criteria, so long as you give reasonable notice. You, and the person whom you have transferred the booking to, will be jointly and severally liable for the price of the tour, and for any costs arising from the transfer. You need to inform us as soon as possible of any requests for alterations and transfers.

14. Your obligations

You shall at all times behave in a safe, responsible and courteous manner; comply with all instructions; regulations and codes of practice issued by us or our suppliers; ensure that you comply with all age restrictions imposed by our suppliers; ensure that you comply with all arrival times, and dress appropriately for the event. If you breach these obligations we may cancel or curtail the event or any part of it and in those circumstances you shall not be entitled to any refund.

Your booking with us indicates that you accept responsibility for any damage or loss caused by any member of your party. Full payment for any such damage or loss must be paid to the supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions. In the event of any customer behaving in such a way as is likely, (in our reasonable opinion) to cause offence, danger, damage or distress to others, we reserve the right to terminate that customer’s tour arrangements and will not be liable for any refund, compensation, or any other costs you have to pay.

You are obliged to take out insurance suitable for your requirements, at the time of making the booking.

15. Responsibility for your holiday

Pelago Travel is responsible for the proper performance of the contract. We are not liable for any failure or improper performance where reasonable care and skill has been exercised or where such failure or improper performance is:

  • Attributable to any member of your party.
  • Attributable to a third party unconnected with the provision of your holiday and is unforeseeable or unavoidable.
  • Due to an event which Pelago or our suppliers, even with all due care, could not foresee or forestall.
  • Our obligations and responsibilities may be limited where international conventions or national regulations apply.
  • All of the photographs and illustrations we use on our website and in literature (including quotations) we send you are for marketing purposes and may not entirely represent the actual products received.

16. Customer feedback

Should any issue arise whilst travelling on one of our tours, the issue should be brought to the attention of the Pelago Tour Leader so that it can be resolved immediately, and where necessary with the involvement of other local suppliers. Once you have returned home any questions and comments should be sent to Pelago Travel, in writing (email is acceptable), at the earliest opportunity and stating any failure that you perceive about your experience of the tour.

17. Data Protection

Any personal data that you provide will be held securely and for the purpose you provided it, in accordance with the Data Protection Act 1998. In order to process your booking and ensure that your holiday arrangements run smoothly and meet your requirements, we need to use the information you provide. The information may include your name, address, age and any special needs, disabilities, dietary or religious requirements etc.

18. Jurisdiction

This agreement shall be construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to deal with any disputes arising between you and us or our suppliers.

19. Changes to these terms and conditions

These terms and conditions govern the contract between you and us, to the exclusion of all other terms and conditions save for those implied by law, and no variation to these terms and conditions shall be valid unless in writing and signed by you and a company director. We may need to make changes to these terms and conditions. Any changes can only be made by us and not any third party member. We reserve the right to amend or improve these terms and conditions without prior notification. When it is necessary for changes to be made, we will forward you a copy of these changes and all further reservations will abide by the amended terms, with the exception of reservations already made.
